State materials read 'gender' as sex

The law says that when a word refers to a person's gender, it means the person's sex. Public schools, the state university system, and all state agencies must use this reading. It covers policies, records, forms, rules, standards, procedures, guides, materials, instruction, training, correspondence, advertising, and marketing. This does not apply where federal law requires a different approach.

Gendered words include all genders

Words like "he" or "she" in North Dakota law include people of other genders. Courts and state agencies must read gendered words as inclusive. This is an interpretation rule and does not change taxes or payments.
