County and township drain crossing costs

When a bridge or culvert is planned on a county or township road over a drain, the water resource board must notify the local highway authority and allow time for input. The county or township maintains the structure. Maintenance costs are split 40% county and 60% water resource board, unless they agree on a different split. Construction costs may include State Water Commission funds when available; any remaining cost is 40% county and 60% to the district that created the need. On request of the water resource board, the county must seek federal emergency funds; any costs beyond federal aid are split using the same 40/60 rule. If the highway authority and the board cannot agree on whether maintenance is needed or how to do it, the requesting party can appeal under chapter 28-34.

Control valves on some highway culverts

If a state highway culvert crosses a drain and that drain’s watershed spans three or more counties, the culvert must include a control valve system. This lets officials regulate water flow for those large watershed crossings.

Bridges for farms cut by drains

The water resource board must build a bridge or culvert if a drain cuts through a private farm and a crossing is needed. The board also maintains that structure. The cost to build is charged to the drain’s construction costs. Ongoing upkeep is treated as part of drain maintenance.
