The law provides $3.2 million from the general fund for July 1, 2025 to June 30, 2027. The Attorney General uses this one-time money to hire a consultant to assess foreign adversary threats to the state. The act is an emergency measure and takes effect immediately, so the work can start right away. This does not pay money directly to households.
A consultant must work with the Department of Emergency Services to study North Dakota’s risks from foreign adversaries. They must review infrastructure, technology, agriculture, energy, and academia, look beyond land deals, check investments for legal compliance, flag unmonitored areas, and propose fixes. A written report with sector risks, recommendations, and a plan to set up a state intelligence unit is due to the Attorney General by July 1, 2026. The Attorney General and the Department must present the findings and any needed bills to Legislative Management before September 1, 2026.
The assessment findings stay only with the Department of Emergency Services. The law treats them as exempt records under chapter 44-04. The public cannot get the detailed report through the open records law.
