Lower perpetual care deposits for cemeteries

Cemetery operators must now deposit 10% of each sale into the perpetual care fund, not 20%. Adult spaces: at least 10% or $20 per space, whichever is higher. Child spaces: at least 10% or $5 (up to 42 inches) or $10 (up to 60 inches), whichever is higher. Mausoleum and other above‑ground spaces: at least 10% or $100 per space, whichever is higher. Columbarium niches: at least 10% or $10 per niche, whichever is higher. If the cemetery’s main fund already equals at least 10% of lot‑sale proceeds, a public mausoleum or columbarium must also keep at least 10% of its construction cost in its own care fund. These rules apply to spaces sold after the law takes effect.
