AN ACT to amend and reenact sections 15.1-09-33 and 15.1-19-03.1 of the North Dakota Century Code, relating to a requirement for public school students to have the opportunity to recite the pledge of allegiance each morning and immunity for liability stemming from the recitation of the pledge of allegiance.

Schools can offer daily Pledge of Allegiance

Local public school boards can let schools start the day with the Pledge of Allegiance. Participation is voluntary, and no student must recite it. Parents can submit a written request to excuse a child, allow the child to stand quietly, or to have the child salute the flag instead. If not excused, a student must stand with the right hand over the heart; male students remove headwear unless worn for religious reasons. Schools must tell families about these options, such as in the student handbook. Each local board decides whether to offer the pledge; it is not required statewide.
