K-12 expulsion limits and reviews

Districts can expel a student, including those in alternative programs, for up to 12 months for insubordination, habitual indolence, or disorderly conduct. These expulsions cannot extend past the end of the current school year. For violating the district weapons policy, a student can be expelled for up to 12 months. When setting the length, the district must consider the offense’s severity, the student’s age, and prior discipline. If the student meets the district’s reinstatement conditions, the district can review and shorten the expulsion.

K-12 suspension limits and grounds

Schools can suspend a K-12 student for up to 10 days per incident. Reasons include insubordination, habitual indolence, disorderly conduct, or violating the district weapons policy. If the student is in a state-paid alternative education program, the cap is 20 days per incident.

K-12 expulsion hearings and parent rights

Each school board must have written rules for suspensions and expulsions. Before any expulsion, the student gets a due process hearing using procedures set in state law. A parent or the student’s representative is allowed to take part in the hearing.
