Mask violations are a Class A misdemeanor

Breaking any of these mask rules is a Class A misdemeanor under North Dakota law. You face criminal charges and the penalties set for that offense.

No masks for crime or threats

The law makes it illegal to wear a mask, hood, or face covering to intimidate, threaten, abuse, or harass another person. It also bans wearing a covering to avoid being recognized while committing a crime. After you are charged, arrested, or convicted, you cannot wear a covering to hide your identity to flee or escape. These rules focus on the wearer’s intent to threaten, evade, or escape.

Unmask in groups, Halloween exception

You cannot wear a mask to hide your identity while gathering in public with others who are masked if you refuse an officer’s request to unmask. Public Halloween, masquerade, or similar celebrations are exempt from this group rule. The exemption does not change the other prohibitions in this law.
