The law bars a convicted student from attending the same school as the victim. The district must create and enforce a safety plan that requires no contact and separation in buildings and activities. Schools must choose steps to keep the convicted student out or apart: hold an expulsion hearing with due process on the legal timeline, move the student to an alternative or virtual program, or move the student to another school or building. If a transfer is not possible, the student must be kept separated from the victim at all times in school and activities.
The law defines a "convicted student" as a student adjudicated delinquent or an adult student convicted of sexual assault against another student in the same school. "Sexual assault" means a nonconsensual offense under chapter 12.1-20 that includes a sexual act or sexual contact. When adjudication or conviction happens, the state's attorney must tell the student's school about court findings that matter under this law. This notice lets the school start safety plans, transfers, expulsions, or separation steps right away.
