Reports and audits required for tribes

Tribal governments that get money must file a yearly report on how they used it. They must also submit an independent CPA audit every two years; they may use fund money to pay for it and may audit more often. The department withholds payments until late reports or audits are filed. If an audit or review finds improper spending, the department withholds future payments equal to the amount used the wrong way. It releases withheld money when a later audit shows proper use.

New fund for tribal public health

The law creates a Tribal Health Care Coordination Fund in the state treasury. The Department of Health runs it and signs written agreements with each tribe. Money must support the CDC’s 10 essential public health services and community health representative programs or services. No more than 50% may go to capital construction through June 30, 2027; after that, no more than 35%. The department distributes at least once a year after its audits and checks. Each tribe’s share is proportional to its federal care coordination funding for services that start within that tribal nation.
