The law caps farm maintenance charges at $4.00 per acre each year. Districts can choose how to bill. Under a proportional method, the highest-benefit farm acres can be billed up to $4 per acre and others pay less by ratio; non-farm parcels follow the same ratio. Under a uniform method, all farm acres pay the same rate, and non-farm parcels pay up to $2 for each $500 of taxable value. These rules apply to land benefited by an assessment drain.
If one year’s levy cannot cover cleaning or repairs, the board may build a reserve fund up to six years of the maximum levy. If a project would cost more than the total the board can levy in six years, the board must get approval from a majority of landowners before taking on the costs. In that election, a benefited landowner who has not paid required assessments cannot vote.
