City home rule limits and filing

When voters approve a city home‑rule charter, it becomes the city’s basic law. The city must file a copy with the Secretary of State and keep one with the city auditor. Courts must officially recognize the charter. A city may not enforce a home‑rule ordinance that conflicts with state law.

County home rule limits and filing

When voters approve a county home‑rule charter, it becomes the county’s basic law. It takes effect the next January 1 or July 1 after the vote. The county must file copies with the Secretary of State, the county recorder or a designated official, and the county auditor. Courts must officially recognize the charter. A county may not enforce a home‑rule ordinance that conflicts with state law. A county charter cannot cut the powers of an organized township board or change a township’s structure without that board’s consent. County ordinances also cannot override state laws 49-22-16 and 49-22.1-13.
