Board members and inspectors can enter and inspect any barbershop, mobile barbershop, or barber school during business hours. Breaking barbering laws or board rules is a class B misdemeanor. This includes letting unregistered people work, getting a license by fraud, not displaying your certificate, or violating mobile shop rules.
Barber licensing and shop fees are set. Master barber exam and renewal each cost $100. A barbershop license is $50 per year; opening a shop has a $100 inspection/application fee. School permits are $125 per year; instructor renewals are $25; a special certificate under section 43-04-38.1 is $175. Restoring expired licenses adds a $20 penalty plus the renewal; a duplicate license costs $10.
The law defines a mobile barbershop and brings it under state rules. Only a licensed barber may operate one, and the shop must be registered with the Board. Each unit must be enclosed, self-contained, at least 16 feet long, and not a towed unit. Owners must keep a mailing address, register each vehicle, display the business name and registration number outside, and provide the make, model, VIN, and plate number. The Board sets rules on water, wastewater, power, safety, sanitation, equipment, services, location, and reporting, and can set fines and fees to enforce them.
