Local jails house inmates when prisons full

When state prisons are at capacity and deny admission, the Department uses local jails. The Department must negotiate an agreement with each facility. Each agreement sets a minimum daily rate per inmate and includes medical costs. Pay starts the day after the Department gets the district court order placing the person in its custody. Pay ends on the admission date the Department provides.
