School districts must protect student data

Beginning July 1, 2026, each school board adopts a student data protection policy. The policy requires board approval before sharing student data outside the district, except with a parent or when the law allows it. It must also allow sharing with the state system only if there is a data sharing agreement that names the Department of Public Instruction as the district’s FERPA-authorized representative. The superintendent keeps lists of all outside data recipients and the job titles that can access student data. The district must give the policy to anyone who asks.

State student system required, with exemptions

Beginning July 1, 2026, each school district must use the state student information system as its main system. Districts must sign a data sharing agreement with the Department of Public Instruction and use state course codes for all classes. A public school also needs a data sharing agreement in place to be approved by the state. The superintendent of public instruction may exempt a district if its local system is compatible with the statewide longitudinal data system, or comparable under Bureau of Indian Education rules.
