Cities can sell property through brokers

A city's governing body can pass a resolution to sell named property, set a maximum commission, and keep the right to reject any offer. After posting the resolution on the city website for at least 14 days, if the city has one, it can hire licensed brokers. The city can use nonexclusive listings, or an exclusive listing only after a competitive process. Exclusive-listing proposals must show broker experience, similar sales, a marketing plan, and the fee. The city may also pay a buyer’s broker and must weigh that cost in the total fees.
