Arrests for false or harassing reports

Peace officers can arrest without a warrant for harassing a public safety agency or making a false report, as defined in 12.1-17-07(4). Officers can take the person into custody right away. This aims to curb false reports and harassment of public safety agencies.

Federal agents can arrest without warrants

A federal agent on duty can arrest without a warrant in specific cases. These include: the person commits an assault or other chapter 12.1-17 crime in the agent’s presence; the agent has reasonable cause the person committed such a crime; the agent has reasonable cause the person committed a felony; or the agent gets reliable information that a peace officer has a warrant for the person. This authority applies only while the federal agent is on duty.

Immediate custody for 24/7 sobriety violations

An officer can take an individual into custody without a warrant if the officer has reasonable cause to believe the person violated a court order to take part in the 24/7 sobriety program (NDCC 54-12-27 to 54-12-31). A person held under this rule cannot be released on bail or personal recognizance until making a personal appearance before a magistrate.
