No-fly drone zones over homes and farms

The law makes it a crime to fly a drone over someone else’s homestead or secure farm areas and keep it there. A first offense is a Class B misdemeanor. A later offense is a Class A misdemeanor. Using a drone with a camera or other surveillance gear over those areas is a Class A misdemeanor. These rules apply when you do not own or lease the property, you control the flight, and the drone remains over the area.

What counts as farms and livestock

An animal feeding operation is a site where non‑aquatic animals are kept and fed 45 days or more in any 12 months, and crops do not grow there in the normal season. Farming or ranching means growing crops or raising animals, poultry, milk, or fruit. Timber production and farm services done by a processor under a contract do not count. Livestock includes cattle, dairy cattle, sheep, pigs, poultry, horses, bison, elk, fur animals, and other farm‑raised animals. These definitions set which sites and activities get the drone protections.

When drone flights are allowed

These crimes do not apply if the owner gives consent. They also do not apply to reasonable commercial or farm flights that follow FAA rules, approvals, or exemptions. They do not apply to flights that collect weather or climate data. They do not apply to flights over 400 feet above the ground. State, local, or federal government flights with legal authority, and public utility flights under state law, are also exempt.
