After a full calendar year of operation, you must report by February 1 the prior year’s cigar and pipe tobacco sales as a share of gross income. If that share is 15% or more, the tax commissioner renews your certificate. The commissioner can require proof and will not renew without it. Your report is confidential under state tax law. A cigar must be hand-made with a whole-leaf wrapper, no filter, and weigh at least six pounds per 1,000; a cigar lounge is certified and gets at least 15% of income from selling cigars and pipe tobacco.
To allow indoor smoking, your lounge must hold a valid certificate from the tax commissioner. On your first application, you state that you have a humidor, full enclosure (solid walls or windows, a ceiling, and a solid door), and ventilation that does not send exhausted air or smoke into nonsmoking areas. The commissioner cannot ask for cigar-sales income on the first application and must issue the certificate once you report these features. A certified lounge may allow smoking only of cigars and pipe tobacco bought on-site. No other products may be smoked on the premises.
