The law stops most state or local agencies from requiring a vaccine unless they offer an opt-out for health, religious, or philosophical reasons. The opt-out does not apply to the department of corrections and rehabilitation; correctional facilities; law enforcement; local public health units; human service zones; the state hospital; and developmental disability residential facilities or other health care providers, including long-term care, basic care, and assisted living providers. Schools, day cares, child care, Head Start, and nursery schools follow section 23-07-17.1 instead. During a public health disaster or emergency declared under chapter 37-17.1, agencies may require vaccines without offering this opt-out.
Schools, day care centers, child care facilities, Head Start, and nursery schools must follow the vaccine and exemption rules in section 23-07-17.1. They do not use the new opt-out law. Parents should use the existing school or child care process for any exemptions.
