You can buy up to 2.38 gallons (9 liters) per month from a licensee for personal use. You may not buy more than this amount or buy for resale.
The tax commissioner may issue event permits to a manufacturing distillery for up to 40 event days each year. With permits and subject to local rules, the distillery may give free samples and sell by the glass or in closed containers at events and at its satellite location. Packages for direct sales must follow state labeling rules in section 5-01-16. Off-sale retail is allowed on Sundays from 12 noon to 12 midnight if a local ordinance allows it. A manufacturing distillery may not wholesale; sales to other retail premises must go through a licensed North Dakota liquor wholesaler, with a narrow exception for sales to a domestic winery when the spirits were made from that winery’s products.
