The statement covers you and your spouse. You must name your employer and main source of income. List each business or trust where you or your spouse have a financial interest. List groups you or your spouse are closely tied to or lead if your official actions could affect them. Name all business offices, directorships, and fiduciary roles you or your spouse held last year. If you or your spouse sold over $5,000 to a state agency or local government last year from an employer or business you own at least 10%, list those sales.
Candidates must file a statement of interests when they file nomination, endorsement, petition, or write-in papers. If you filed for the primary, that filing counts for the general election. In a presidential year, presidential and vice-presidential candidates may file their federal personal disclosure instead. If the governor appoints you, you must file when the appointment is announced. While in state office, you must file each year by January 31; federal officeholders are excluded. If an error is not fixed by the 64th day before the election, your name cannot appear on the ballot. Late filers must pay the late fee set in section 16.1-08.1-06.1.
The secretary of state and local auditors accept and file these statements. Anyone can view them during office hours. A reasonable copying fee may be charged, and fees go to the government’s general fund. All statements filed with the secretary of state are posted on the secretary’s website. Records are kept for the official’s term or until a new statement is filed, and for one year for people not elected or appointed.
