Protects discounted drugs at contract pharmacies

The law protects access to discounted drugs at contract pharmacies that serve covered entities. A drug maker, its agents, or logistics partners commit a class B misdemeanor if they block or limit a pharmacy from getting or dispensing these drugs. They cannot deny access, require claims or use data as a condition (unless federal law requires it), or interfere with dispensing to an eligible patient. They also cannot offer the drug only as a rebate; any price break must be a discount at sale and allowed by federal law. Exceptions: when federal law bars receipt, for limited distribution required under federal drug safety rules, or as allowed by section 43-15.3-09. The law defines contract pharmacy, covered entity, and drug for these rules.
