Beginning January 1, 2027, if a plan’s dental loss ratio is under 83.75%, the insurer must return money. People and groups covered that year get a refund or a 12‑month premium credit. Total refunds must equal the extra premium above what was needed to reach 83.75%. The law defines how to count care costs and earned premium, and excludes certain taxes and fees. The commissioner may waive or adjust refunds only if paying them would cause insurer financial impairment, and may make rules.
Starting January 1, 2027, dental insurers must file next year’s rates and group rating changes for review. The insurance commissioner can block rates that are excessive, inadequate, or unreasonable. The commissioner can also block group rating factors that are discriminatory or not actuarially sound. A rate is excessive if admin costs rise over 4%, surplus exceeds 2% of revenue, or the loss ratio is under 83.75%. If disapproved, the insurer gets 45 days’ notice, can seek a hearing in 10 days, held within 15, with a decision in 30. For threshold disapprovals, the commissioner holds a public hearing, and the insurer must notify covered employers and people.
Starting January 1, 2027, these rules do not apply to a dental insurer with 1,000 or fewer enrollees on a three‑year average. This exemption uses total enrollees across all plans. Enrollees of exempt insurers do not get these filing, loss‑ratio, and refund protections.
