Felony and prison for DUI injuries

The law makes it a class CB felony to violate the state DUI law and, as a result, cause substantial or serious bodily injury to another person. A conviction under this provision carries a mandatory minimum of at least 1 year and 1 day in prison. If you have a prior conviction under section 39-08-01 or 39-08-03, or an equivalent local ordinance, the minimum is at least 2 years. This strengthens penalties for DUI crashes that injure people.
