Arson now covers your own property

The law makes it arson to burn or blow up your own property to get insurance money or to harm someone with a legal interest. Legal interest includes joint owners and people who financed the property, like mortgage lenders or lienholders. For personal property, this applies when the loss is more than $2,000. Arson under this section is a class B felony.

New rules and penalties for dangerous fires

The law makes it a crime to willfully start or keep a fire or cause an explosion that recklessly puts people, buildings, or vital public facilities at risk. It also covers damage to another person’s property over $2,000. Being drunk or on drugs that helped start the fire is prima facie evidence of intent. A “person in danger” includes firefighters, volunteer firefighters, police, and emergency medical staff during a response. If someone dies, it is a class A felony; extreme indifference is a class B felony; other cases are class C felonies.
