Water service stays on during state loans

If your local water system has a loan from a state agency, its service cannot be cut during the loan. Service cannot be limited because the area is added to another city or district, or because a private franchise is granted. The provider does not need a new franchise, license, or permit to keep serving the area. Cities or districts can make a service deal only if the state lender signs it and bond payments are protected. Only the state lender can enforce these rules; local governments cannot sue under this section. Deals made before January 1, 2025 that break these rules can be canceled by the lender with 30 days’ written notice, and this does not affect lawsuits started before January 1, 2025. These rules apply retroactively to July 31, 1997.
