Backup generators face fewer siting rules

The law defines backup electric generation as power not tied to the grid and used only temporarily when the main source is down. Onsite backup generators are not treated as an electric energy conversion facility under state siting rules. Projects that meet this backup standard can face fewer state siting steps and less paperwork.

New application fee for energy siting

Applicants who certify to the North Dakota Public Service Commission under subsection 34 of section 49-22-03 must pay a fee. The commission sets the amount to cover its expected costs to process the application. The law does not list a dollar figure.
