AN ACT to create and enact a new section to chapter 12-44.1 and two new sections to chapter 54-23.3 of the North Dakota Century Code, relating to the correctional facility grant program, housing task force, and criminal justice data collection; to amend and reenact section 12-47-31 of the North Dakota Century Code, relating to offenders released from the department of corrections and rehabilitation; to provide for a statement of legislative intent; to provide for a legislative management study; and to provide for a legislative management report.

Help with photo IDs, Medicaid, transport

If you are being released, Corrections helps you apply for a driver’s license or photo ID before release. Corrections gives needed clothing and transport to a reasonable place in your release plan. If you are eligible, Corrections and Health and Human Services connect you to Medicaid or other health programs before release.

Better justice and health data sharing

Corrections works with Health and Human Services, courts, parole and probation, and local jails to review justice data. The report recommends uniform data points, standard and automated processes, and better connections across systems. It includes a portal plan to alert Health and Human Services when an offender’s Medicaid status changes.

Corrections will seek federal re-entry grants

Corrections applies for U.S. Department of Justice grants to support re-entry work. Grants can fund a temporary justice reinvestment coordinator and help pay for program costs.

Court reports on racial disparity progress

The North Dakota Supreme Court sends the legislature a yearly report on steps it takes to reduce racial disparities in the courts. The report follows the work identified by the Minority Justice Implementation Committee.

Grants to expand jail re-entry programs

The Department of Corrections creates a correctional facility grant committee. The committee sets rules and awards grants to county, regional, and tribal jails. Grants go first to facilities that lack re-entry, education, or counseling programs, and can fund culturally responsive treatment. The law provides $1.5 million one time for July 1, 2025 through June 30, 2027 to run the grants.

Native American re-entry program and funding

Corrections, with North Dakota tribes and the Indian Affairs Commission, runs a Native American re-entry program. The program assesses needs, trains staff in culturally responsive care, names a liaison, tracks results, and reports each year. The law provides $25,000 for program costs for July 1, 2025 through June 30, 2027.

Study expanding criminal record sealing options

During the 2025–26 interim, legislative management studies how to expand criminal record sealing. The study looks at automating sealing for those already eligible, expanding who can seal records, and whether to add expungement. Findings and any bill ideas go to the 70th Legislative Assembly.

Housing task force for people leaving custody

Corrections creates a housing task force with parole and probation, the Housing Finance Agency, Health and Human Services, and housing providers. The group works to remove housing barriers for people leaving custody. Each year it reports on housing assistance options, who could qualify, housing for sexual offenders, provider coordination, and sober and low‑barrier housing capacity.
