Advertising, selling, making, distributing, or keeping kratom without a retailer license is a class C felony. Selling a kratom product that is not registered is a class A misdemeanor. If a kratom product contains a listed controlled substance, sellers are charged under state controlled‑substance laws.
Retailers must get a state license and pay a fee. They must register each kratom product they sell. Each product must be made in a facility that meets federal dietary supplement rules (21 C.F.R. 111). An independent lab must test products for alkaloids, heavy metals, and other contaminants. Labels must warn against use by people under 18, pregnant, or breastfeeding, say it may be habit forming, advise talking to a provider, state it was not FDA‑evaluated, and list all ingredients and alkaloid amounts. The department posts a public list of registered products and writes detailed rules.
Retailers cannot sell kratom with over 2% 7‑hydroxymitragynine in the alkaloid fraction. Products with synthesized material or boosted isolates are banned. Products must meet solvent limits in United States Pharmacopeia chapter 467. Items made for smoking, vaping, or injecting are banned. Adulteration with certain drugs or psychoactive substances is banned. Retailers may not market or sell to anyone under 18. Selling to a minor is a class A misdemeanor.
During the 2025–26 interim, Legislative Management studies kratom uses and rules. It reports findings and any proposed bills to the seventieth legislative assembly.
