PSC approval for big data centers

Public utilities and covered data centers must get Public Service Commission (PSC) approval before building or operating. A covered data center stores or processes digital information, uses 20 megawatts or more, and is owned by an investor‑owned utility. Data centers run by electric cooperatives are exempt.

Fees and rules for PSC certificates

The PSC charges up to $10,000 per application to cover processing costs; more is allowed only with Emergency Commission approval. Your application must include a financial statement, service description, service-area map, and a list of similar providers. Corporations and LLCs must also file certified articles. The PSC sets a hearing at least 20 days after you file and mails certified notice at least 10 days before. If no one asks for a hearing after at least 20 days’ notice, the PSC may grant the certificate without a hearing. At the hearing, you must show needed local permits or that you applied, and the PSC can approve, deny, or approve part of a project and add conditions.
