Agencies cannot certify federal carry status

Law enforcement agencies and certified concealed-weapon test administrators can certify that a person kept North Dakota firearms qualifications. They cannot certify anyone for federal retired-officer concealed-carry status under the 2010 federal law. Agencies and test administrators must also send the POST board a record of everyone who passed a firearms proficiency course.

Retired officers count as law enforcement

The law recognizes some retired law enforcement public servants as law enforcement officers. You qualify if you served at least 10 years, or left because of a service-related physical disability. You must keep firearms skills under an approved standard. This can be the POST board level, your former agency’s active-officer test in your state, a certified instructor’s active-officer test in your state, or a standard set by the attorney general for certified concealed-weapon test administrators. You must hold a local law-enforcement photo ID that shows you passed a firearms test within 12 months of the card’s issue. You also must not be found unfit for mental-health reasons, and you must not have signed an agreement saying you are unqualified for mental-health reasons.
