AN ACT to provide an appropriation for defraying the expenses of the industrial commission and the agencies under its control; to create and enact a new section to chapter 6-09 and a new subdivision to subsection 2 of section 38-08-04.5 of the North Dakota Century Code, relating to a rail revolving loan fund and uses of the abandoned oil and gas well plugging and site reclamation fund; to amend and reenact subsection 7 of section 6-08.1-02 and sections 6-09-35, 6-09-46.2, 6-09.7-05, 6-09.14-04, and 49-17.1-02.1, subsection 1 of section 54-17-40, and subdivision a of subsection 4 of section 54-17.7-04 of the North Dakota Century Code, and section 15 of chapter 14 of the 2023 Session Laws, relating to confidential and exempt records of the Bank of North Dakota, the rebuilders loan program, loan guarantees through the strategic investment and improvements fund, interest rate buydown limits for the partnership in assisting community expansion fund, department of transportation review and approval of rail projects, uses of the housing incentive fund, North Dakota pipeline borrowing authority, and a salt cavern underground energy storage research project; to repeal section 3 of Senate Bill No. 2188, as approved by the sixty-ninth legislative assembly, relating to a transfer from the strategic investment and improvements fund to the clean sustainable energy fund; to provide a deficiency appropriation; to provide for a transfer; to provide an exemption; to provide for a legislative management study; to provide for a legislative management report; to provide for a report; to provide an effective date; and to declare an emergency.

Funding for state bond payments

The Industrial Commission’s budget includes $119.88 million to pay state bond obligations in July 1, 2025–June 30, 2027. $102.62 million comes from the infrastructure project and program bonds legacy sinking and interest fund. $15.02 million comes from the North Dakota University System. This keeps bond payments on time during the biennium.

Bank profits fund budget and loans

The Bank of North Dakota transfers $140 million to the state general fund during July 1, 2025–June 30, 2027. The budget office sets the timing after consulting the bank. The bank also sends $61.5 million to growth programs: $39 million for PACE, $5 million for Ag PACE, $1 million for Biofuels PACE, $15 million for the Beginning Farmer Revolving Loan Fund, and $1.5 million to UND to match Small Business Development Center grants.

Housing Finance Agency funds and flexibility

The Housing Finance Agency gets $71.24 million for July 1, 2025–June 30, 2027. Of this, $68.74 million is other funds and $2.5 million is general fund. The agency may also use any extra federal or special funds it receives and must notify OMB and Legislative Council when that increases its spending authority.

Industrial Commission admin transfer authority

The Industrial Commission can move up to $1,818,114 to cover admin services during July 1, 2025–June 30, 2027. Transfers happen by order of the commission and follow limits for the student loan trust fund. A prior $1,818,114 appropriation stays available to the commission for admin services during this biennium.

Lignite research money and reporting

Up to $4.5 million from the lignite research fund is available for studies, technology support, marketing, environmental work, transmission, and related litigation. Funds support lignite marketing and development. The Industrial Commission must report spending under this section to the seventieth legislature’s appropriations committees.

Mineral Resources department budget set

The Department of Mineral Resources gets $28.38 million for July 1, 2025–June 30, 2027. $28.11 million is general fund and $268,000 is other funds. The law authorizes 108.00 FTE.

State Mill and Elevator budget

The State Mill and Elevator gets $97.41 million for July 1, 2025–June 30, 2027. $54.02 million is for salaries and $42.39 million is for operations. It also sets $500,000 for contingencies and $500,000 for agriculture promotion, and authorizes 170.00 FTE.

Bank of North Dakota operations funding

The Bank of North Dakota gets $71.6 million for July 1, 2025–June 30, 2027. $70.9 million is for operations and $705,722 is for capital assets. The law authorizes 187.00 FTE for this period.
