The state banking board and the state credit union board must meet together to approve the department’s annual or biennial budget and staff positions. A majority of each board must be present, and a majority of those present on each board must approve. The commissioner’s salary and expenses must fit the board‑approved budget and the legislative salary appropriation. Staff pay must also fit those limits. Deputies and staff can be repaid for actual and necessary travel while on duty. These rules apply through June 30, 2029.
North Dakota creates a special fund for the Department of Financial Institutions. The department must deposit its fees and other money into this fund. Money in the fund is available on a continuing basis to run the department, but only within an annual or biennial budget approved by both boards. The department must keep and report revenue and spending records as the office of management and budget requires. Unspent cash carries forward to the next biennium, and investment earnings stay in the fund. These rules apply through June 30, 2029.
