New rules for arrests on tribal warrants

North Dakota officers can arrest you when shown a tribal arrest warrant. They can also arrest without the warrant in hand if they have probable cause you are named in a tribal warrant. This applies only to warrants for crimes that tribal law punishes as misdemeanors. You may sign a written waiver to skip seeing a judge and agree to transfer to the tribe. Before you sign, an officer must tell you the tribe’s name, your right to a lawyer, and your right to see a district judge. If you do not waive, you must be taken without unnecessary delay to the nearest district judge, who continues custody when shown the warrant, or after testimony or an affidavit shows probable cause for a warrantless arrest.
