Time limits and start date for people on probation

The law sets clear caps on supervised probation in North Dakota. The limit is five years for certain serious felonies named in state law. These include firearm or dangerous‑weapon felonies, repeat violations of protection orders, and offenses listed in sections 12.1-32-09.1, 12.1-32-02.1, 12.1-17-07.1, chapter 12.1-41, and section 14-09-22. Other felonies are limited to three years. A class A misdemeanor is limited to two years, and a class B misdemeanor to 360 days. The probation clock starts on the latest of: the court’s probation order; release from jail or an alternative program; or when parole ends. This caps supervision time, but starting the clock later can mean more time on probation after release.
