State agencies can buy small items with online terms

The law lets state agencies buy routine, small products that come with shrink-wrap, click-through, or third-party license terms, even if those terms conflict with the state’s normal liability limits. Before buying, the agency must consult the Attorney General’s office and the Office of Management and Budget. The agency must find no reasonable risk of an improper obligation or a loss that cannot be limited under this law. It must consider the product’s intended use, including data and system security. Items must be sold to the public and stay within the agency’s routine procurement cost limit.
