State hospital care for eligible residents

The state hospital must, under Department of Health and Human Services rules, admit and care for all eligible North Dakota residents with severe mental illness, including substance use disorder. The hospital provides needed food, shelter, treatment, and support. Eligibility and residency follow state law and department policies.

Accreditation funding and clear hospital rules

The department must set rules and policies for how it runs institutions it manages, including the state hospital. It must seek appropriations and other resources to keep the hospital accredited by the Joint Commission and certified by the Centers for Medicare and Medicaid Services, or similar recognized bodies accepted by the department. This helps keep care quality high and allows federal payments. Funding depends on the appropriations process.

New governing board for state hospital

The Department of Health and Human Services, with the state hospital, creates a governing body and sets its powers by rule, policy, or bylaws. Members include the DHHS commissioner or designee; the behavioral health director or designee (chair); the hospital superintendent; the medical director; a fiscal administration representative; a behavioral health consumer chosen by the Mental Health Association; and a legislator named by legislative management. The board may add other members. Members who are not DHHS employees get $100 per day and expense reimbursements under sections 44-08-04 and 54-06-09.
