State workers: travel pay tied to GSA

If you are a North Dakota state officer, employee, representative, or agent, the law updates travel pay. For in‑state travel each day, you can get $9 for 6:00 a.m.–12:00 p.m. (not if travel began after 7:00 a.m.), $14 for 12:00 p.m.–6:00 p.m., and $22 for 6:00 p.m.–12:00 a.m. For hotel stays between 12:00 a.m. and 6:00 a.m., you are reimbursed for what you actually pay, up to a cap set by policy at 90% of the federal lodging rate plus taxes. For in‑state hotels, the allowance equals the federal city lodging rate plus any state or local taxes; if no federal rate exists, the director sets it. Lodging outside North Dakota is reimbursed at the actual amount you pay. If you are permanently located outside the state or on an assignment over 30 straight days, you are paid the federal mileage rate for each official mile you drive, and the usual 300‑mile limit does not apply.

Legislators: new monthly lodging cap

If you are a member of the Legislative Assembly, your monthly lodging pay is capped. On August 1 of each even‑numbered year, the director sets the maximum for the next two years at 30 times 75% of the daily lodging rate in effect that day. During session days, your per‑day claims also cannot exceed the daily lodging limit set for state travel and the director’s in‑state allowance. You may choose to claim less by writing a smaller amount on your voucher and attaching the required receipt. Legislative management may set rules that reduce the max when two or more legislators share one dwelling and the total rent is above each person’s entitlement.
