After a hearing, the agriculture commissioner can deny, suspend, revoke, or change a pesticide certification. Reasons include breaking this chapter or its rules, a criminal conviction under FIFRA section 136l, a final civil penalty order under that section, or a concluded state enforcement action for pesticide violations. These changes increase the risk of losing certification for violations and strengthen enforcement of pesticide laws.
North Dakota ties pesticide certifications to U.S. EPA rules in 40 CFR 171.101–171.107 as they existed on January 4, 2017. The pesticide control board must use those standards when it sets state rules. Those federal standards are now part of state law and apply to people who apply or sell pesticides. The board must also report to the EPA in the form that agency requires. This can change training, testing, and supervision needs for certification.
You cannot use a restricted use pesticide unless you are certified or directly supervised by a certified applicator. A competent person may apply a restricted use pesticide under a private applicator’s direct supervision, unless the label says a certified applicator must personally apply it. People applying nonrestricted pesticides under direct supervision do not need certification, unless the label requires it. Direct supervision means instruction and control, with the certified applicator physically available if needed. If the work is done by aircraft, the pilot must be properly certified. A restricted use pesticide is any product the EPA or the state agriculture commissioner classifies as restricted.
