Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 1 costs, 1 mixed.

Easier paths to EMS certification

The Department of Health and Human Services sets minimum statewide rules for EMS training, testing, certification, licensure, and quality review. The rules cover EMS personnel, community EMS, instructors, and training schools, and define standards and how people get certified or licensed. EMS instructors can directly teach entry-level EMR and EMT courses under department oversight without being an EMS training institute. Getting licensed as an EMS training institution is optional.

Penalty for fake EMS credentials

It is a class B misdemeanor to willfully lie about your EMS certification or license. This covers anyone who knowingly misrepresents being certified or licensed as EMS personnel. Violators can face criminal charges under North Dakota law.

EMS quality review records protected

EMS quality review and improvement records are confidential. They cannot be subpoenaed, discovered, or used as evidence in any civil case. This protects candid internal reviews and improvement work. It may also limit what plaintiffs can access in lawsuits.
