Breaking this chapter, its rules, or a department order can bring a civil fine up to $5,000 per day. Willfully violating the law after written notice is a class A misdemeanor. Willfully lying in required documents or tampering with monitors or samples is also a class A misdemeanor, unless another penalty applies. Rulemaking, compliance cases, and appeals follow the state's normal administrative and court review rules (chapter 28-32).
Operator certificates last one year and expire on January 1 after issue. The department sets fees by rule, based on program costs. The first certificate fee is capped at $50; annual renewal at $25. All fees go to a special fund to run the program and support training. The department holds at least one exam each year and can use outside testing. It takes applications, keeps records, and runs training.
