Technical hearings for energy projects

The Public Service Commission can hold a technical hearing on energy siting applications. It can start the hearing on its own or at the request of a directly interested person. Parties may present evidence and examine and cross-examine witnesses under state hearing rules. This applies to cases under chapters 49-22 and 49-22.1, including gas and liquid projects.

New definitions for energy project siting

Utility‑scale energy storage now counts as an electric energy conversion facility and must follow chapter 49-22 permits and site rules. The law defines repower for wind as replacing turbine equipment that raises output or height; routine maintenance and simple part swaps are not repowering. For gas and liquid projects, a road use agreement now clearly covers heavy road permits, access points, crossings, setbacks, dust control, and road repair plans.

Wind farms must use light mitigation

The commission adopts rules by January 1, 2019 for light‑mitigating systems that follow FAA standards. Wind projects with certificates issued after June 5, 2016 must have working systems by December 31, 2019. Projects with certificates issued before June 5, 2016 must comply by December 31, 2021. After a public hearing, the commission may grant a waiver or more time for technical or economic reasons. Owners must pay all costs to install, run, and maintain these systems.
