AN ACT to create and enact section 26.1-26-33.1 of the North Dakota Century Code, relating to obligations of insurance producers to maintain an electronic mailing address for regulatory use; to amend and reenact sections 26.1-26-11, 26.1-26-22, 26.1-26-42.1, 26.1-26.8-09, 26.1-26.8-11, and 26.1-26.8-12 of the North Dakota Century Code, relating to producer's lines of insurance, service of process for producer proceedings, revocation of nonresident producer licenses, requirements for renewal of business entity public adjuster licenses, public adjuster proof of insurance requirements, and public adjuster continuing education requirements.

Faster loss of nonresident producer licenses

If you hold a North Dakota nonresident producer license, the commissioner can suspend or revoke it without notice or hearing when your home‑state license is revoked or suspended. The commissioner can also act 60 days after learning your home‑state license missed its renewal deadline. Proof can be a certified record, an email, or information from the national producer database.

New email and notice rules for licensees

Licensed producers and public adjusters must keep an email address for the regulator and check it. The commissioner can serve legal notices by email to that address or by U.S. mail, and service counts when sent. Licensees must report any change in legal name, mailing address, or other submitted info within 30 days. They must also tell the commissioner before using a trade name. Not reporting can mean fines up to $500 per violation or license suspension.

Product lines for producer licensing

North Dakota lists the product lines for producer licenses: life and annuity; accident and health or sickness; property; casualty; and variable life and variable annuity. This clarifies what products producers may sell in the state.

Reporting and license info requirements

Licensees must report any administrative action in another state or by another agency within 30 days and send copies of the order. They must also report any criminal conviction within 30 days and include the complaint and court order. Licenses must show your name, mailing address, license number, issue date, lines of authority, and expiration date. The commissioner may contract with private groups, including the national insurance association, to collect fees and process filings. The commissioner may set renewal procedures by rule.

Business adjuster license renewals and fees

Business‑entity public adjuster licenses expire two years after issue, on the last day of the following month. Entities must file a biennial continuation to renew. You can renew in the 90 days before expiration; the renewal fee cannot be more than $150. If the license lapses, you have 30 days to renew with a late fee up to $125, in addition to the renewal fee. A renewal in that 30‑day window is treated as on time.

Individual public adjuster renewals and fees

Individual public adjuster licenses expire two years after issue, on the last day of the month of the adjuster’s birthday. To renew, you must file a biennial continuation and pay $25. If you miss the deadline, you can reinstate within 12 months without an exam by paying up to $125 plus the renewal fee. The commissioner may waive an exam, fee, fine, or sanction if military service or a long‑term medical disability kept you from renewing.
