Approved loans have an interest rate no higher than 2% and a term up to 20 years. For projects under $75 million, the max loan is $15 million, or 80% of cost up to $12 million if the district’s unobligated general fund balance exceeded the statutory limit. For projects $75 million or more, the max is $30 million, or 80% up to $24 million under the same rule. For Air Force base projects, the max loan is the lesser of 20% of cost or $20 million. Districts with callable open‑market bonds can apply to refinance. Districts previously approved for up to $10 million for projects bid Jan 1, 2021–June 30, 2024 could apply for extra funds up to the new caps, but only by Aug 1, 2023.
The superintendent sets aside $20 million in the loan fund to match loans for facilities on an Air Force base. This reservation lasts until June 30, 2027, or until such a loan is made, whichever comes first.
School districts can apply only for projects that cost at least $1,000,000 and are built to be used 30 years or more. The superintendent must approve the project. Districts must publish the expected mill rate and the dollar change per $1,000 of taxable value, post it on the district website, and win a bond vote. Projects on an Air Force base also need needed federal approvals and funding commitments. The superintendent ranks applications filed in the 12 months before April 1 using student need, building age, safety and vulnerability design, community support, cost, and other set criteria.
The law creates a special revolving loan fund for K–12 school buildings, run by the Bank of North Dakota. The fund holds legislative money, interest earnings, and loan repayments. The Bank can set program policies and charge up to 0.5% of each interest payment as a servicing fee. All principal and interest payments go back into the fund, which is audited each year. Money in the fund is available on a continuing basis to make loans and pay program costs.
