Bigger financing for clean energy projects

The Bank of North Dakota provides a line of credit to the Industrial Commission up to $390 million, at the rate charged to North Dakota governments. The commission can draw on it as needed through June 30, 2029, and any borrowed money goes into the Clean Sustainable Energy Fund. The commission repays the line from fund money; if the fund is short on June 30, 2029, it must request a deficiency appropriation or repay from other appropriated funds. From July 1, 2025 to June 30, 2027, $130 million moves into the fund: $30 million for grants and $100 million to repay the line and to fund loans.

Clean Energy Fund and oversight rules

The law creates the Clean Sustainable Energy Fund in the state treasury. The Industrial Commission can use it on a continuing basis for grants, loans, loan guarantees, and program and authority operating costs. Money comes from legislative transfers, loan proceeds, interest, repayments, donations, grants, and other contributions. Bond proceeds in the fund can only pay for loans or loan guarantees, and the Bank of North Dakota must return all loan principal and interest back to the fund. The fund is audited every year, and the audit cost is paid from the fund.

Cap on loan servicing fees

If you have a loan from the Clean Sustainable Energy Fund, the Bank of North Dakota may keep a small servicing fee from each interest payment. The fee is capped at 0.5% of the interest payment amount.

New rules for energy authority membership

The Clean Sustainable Energy Authority has 18 members: nine voting and nine nonvoting advisors. Voting seats include two legislative co‑chairs, two from the Lignite Research Council, two from the Oil and Gas Research Council, two from the Renewable Energy Council, and one from the Western Dakota Energy Association. Nonvoting advisors include representatives from the Outdoor Heritage Fund board, Commerce, Environmental Quality, Water Resources, Mineral Resources, Pipeline and Transmission Authorities, the State Energy Research Center, and the Bank of North Dakota. Co‑chairs serve two years; other voting members serve four‑year terms, with no more than two in a row; terms start July 1 and are staggered. The authority meets at least twice a year; five voting members make a quorum, and only majority‑approved recommendations that meet the chapter’s purposes go to the Industrial Commission.
