The law creates a statewide 988 crisis hotline program. The health department hires a nonprofit to run it 24/7 and provide follow-up. The hotline offers outreach, de‑escalation, stabilization, resource connection, and acute care coordination. A new 988 crisis stabilization fund pays for the program, and the first $50,000 deposited repays start‑up costs. The state provides $500,000 from the community health trust fund for July 1, 2025–June 30, 2027. The department may set rules and works with the national lifeline and the veterans crisis line for consistent messages. Collected 988 fees are sent to the fund each quarter.
988 crisis agencies and their staff are shielded from most lawsuits for work they do, except for gross negligence or willful misconduct. Phone and internet providers and their contractors are also shielded for 988 service issues like failed transmissions or installing service, unless they act with gross negligence or willful misconduct.
Starting with tax periods on or after January 1, 2026, a small monthly 988 surcharge applies per communication connection. Each year the health department sets the rate, capped at $0.05 per month per connection, and the rate is uniform across technologies. Providers collect it and file monthly; the fee is due by the last day of the next month, and providers may keep 1%. Prepaid wireless service is not charged. If the fee is listed separately, it is not used to compute other taxes or charges, and cities and counties cannot add their own 988 fee. The department tells the tax commissioner the next year’s rate by October 1 each year; providers are notified by November 1.
