Seller protections after radon disclosure

Giving radon test results or mitigation papers does not mean the seller promises they are accurate or that the fix works. The disclosure alone does not let the buyer cancel; the contract must give that right. If the seller or agent follows these rules, they are not liable for claims about radon in the property.

Sellers must give radon disclosure

If you are selling a home or business property, you must share in writing any radon levels you know about before signing a sale or transfer. You must give a radon warning statement and get the buyer’s signed receipt. If the place was tested before, you must share any test results you have and any proof of mitigation. This applies unless the purchase offer says something different.
