Deadlines and exceptions for state claims

To seek money from North Dakota or a state worker, you must give written notice to the Office of Management and Budget director within 180 days after you discover the injury. For a serious injury (as defined in state law), you have one year after discovery. For a death, the personal representative, spouse, or next of kin may give notice within one year after the death. Time does not count while you are incapacitated. Time limits do not apply to claims based on sexual assault, sexual abuse, gross sexual imposition, or other sexual acts defined in state law. If you sue, you must also deliver a copy of the summons or complaint to the director when you serve it.

How the state settles and pays claims

After notice, the budget director promptly tells the agency head, the attorney general, and any insurer. If the state risk fund covers your claim and it is over $10,000, any written settlement needs consultation with the agency head and approval by the attorney general. The director may settle covered claims of $10,000 or less alone, if the claim is in writing. Claims are paid from the state risk management fund unless insurance or a government self‑insurance pool covers them. When the fund pays, it also pays necessary loss‑adjustment costs, like investigation costs and attorney fees. If you accept a settlement, it is final and you fully release the state and the employee.
