If your health plan uses step therapy, your clinician can request an exception. Plans, PBMs, and review agents must approve when the required drug is contraindicated, likely to cause harm due to your condition or past reaction, or is expected to be ineffective. They must also approve if a prior trial at a comparable dose failed, or you previously did well on the clinician’s chosen drug. If approved and the drug is on your plan’s covered list, the plan must cover it. Non-urgent decisions are due in five calendar days, urgent or emergency decisions in 72 hours. If they do not answer on time, the request is approved. Beginning July 1, 2025, the law applies to new coverage and remains in effect through June 30, 2027.
