$50 fine and moving violation for brake use

Using a noisy engine compression brake in a posted no-brake zone is a moving violation in North Dakota. You must pay a $50 fee for each violation. It counts on your driving record like other moving violations.

Truck compression brakes banned in posted zones

If you drive a commercial truck, you cannot use an engine compression brake that makes loud noise in a posted no-brake zone. This applies only where signs show the ban and the brake causes a noise disturbance. Cities and counties can create these zones by ordinance and post signs. The ban does not apply during an emergency.
